This Privacy Policy explains how Elegantrrnew.ddd ("we", "us", "our") collects, uses, stores, and protects personal data when you visit our website or contact us. We process personal data in accordance with:

  • the General Data Protection Regulation (EU) 2016/679 ("GDPR");
  • the Dutch GDPR Implementation Act (Uitvoeringswet Algemene verordening gegevensbescherming, UAVG);
  • the Dutch Telecommunications Act (Telecommunicatiewet), where relevant to electronic communications and cookies;
  • other applicable Dutch and European data protection legislation.

2. Personal Data We Collect and Sources

We may collect the following categories of personal data, obtained directly from you or automatically through your use of the Website:

  • Identity and contact data: name and email address when you submit our contact form or register interest in workshops.
  • Communication data: message content, subject of enquiry, and correspondence history.
  • Technical data: IP address, browser type and version, operating system, device identifiers, pages visited, time and date of visits, referral URL, and approximate location derived from IP — collected via server logs and, with your consent, analytics technologies.
  • Cookie and consent data: your cookie preferences stored in local storage (key: tdde_cookie_consent), including timestamp of consent.

We do not intentionally collect special categories of personal data (Article 9 GDPR), such as health data, through this Website. Please do not include medical or other sensitive information in contact form messages.

Where personal data is collected through the contact form, providing your name, email, and message is voluntary but necessary for us to respond to your enquiry. Without this data, we cannot process your request.

3. Purposes and Legal Bases

We process personal data only where a legal basis under Article 6 GDPR applies:

  • Responding to enquiries — to handle contact form submissions and follow-up communication. Legal basis: Article 6(1)(b) GDPR (steps prior to a contract) and/or Article 6(1)(f) GDPR (legitimate interest in operating our business and communicating with visitors). Our legitimate interest is responding to legitimate requests; we balance this against your privacy rights.
  • Workshop and event enquiries — to manage registrations and provide information about sessions listed on our Events Calendar. Legal basis: Article 6(1)(b) GDPR.
  • Website security and functionality — to maintain secure connections, prevent abuse, and ensure technical operation. Legal basis: Article 6(1)(f) GDPR.
  • Strictly necessary storage — to remember cookie consent choices. Legal basis: Article 6(1)(f) GDPR, in conjunction with the Telecommunicatiewet.
  • Analytics — to understand how visitors use the Website and improve content, only after consent. Legal basis: Article 6(1)(a) GDPR.
  • Marketing measurement — to evaluate campaign performance, only after consent. Legal basis: Article 6(1)(a) GDPR.
  • Legal compliance — to comply with tax, accounting, or regulatory obligations under Dutch law. Legal basis: Article 6(1)(c) GDPR.
  • Legal claims — to establish, exercise, or defend legal claims. Legal basis: Article 6(1)(f) GDPR.

We do not use automated decision-making or profiling within the meaning of Article 22 GDPR.

4. Data Retention

We retain personal data only as long as necessary for the purposes described, in line with the UAVG storage limitation principle:

  • Contact form submissions: up to 24 months after the last correspondence, unless a longer period is required for legal claims or statutory obligations.
  • Workshop registration data: for the duration of the event plus 12 months, unless you request earlier deletion and no legal retention obligation applies.
  • Server logs: typically up to 90 days for security purposes.
  • Analytics data: according to our analytics provider's settings, typically up to 26 months from collection, subject to your consent remaining valid.
  • Cookie consent records: stored locally in your browser until you clear site data or withdraw consent.
  • Financial and tax records: up to 7 years where required under Dutch tax law (Algemene wet inzake rijksbelastingen).

After the retention period expires, data is securely deleted or anonymised.

5. Recipients, Processors, and International Transfers

We do not sell personal data. We may share data with the following categories of recipients:

  • Hosting and IT infrastructure providers — to operate the Website (typically within the EEA).
  • Email service providers — to deliver and receive communications relating to your enquiries.
  • Analytics and advertising partners (e.g. Google) — only where you have given consent via our cookie banner; see our Cookie Policy.
  • Embedded content providers (e.g. Google Maps) — may process technical data when you interact with embedded features; see Section 10.

Where we use processors (verwerkers), we enter into data processing agreements (Article 28 GDPR) requiring them to protect your data and process it only on our instructions.

If personal data is transferred outside the European Economic Area (EEA), we ensure appropriate safeguards, such as:

  • an adequacy decision by the European Commission; or
  • Standard Contractual Clauses (SCCs) approved by the European Commission, supplemented where necessary by additional measures.

6. Online Advertising and Campaign Measurement

We may use online advertising platforms, such as Google Ads, to promote our educational desk-wellness content. Advertising is intended to reach people interested in general movement and posture information — not to offer medical services or regulated health products.

When you consent to marketing cookies via our cookie banner, advertising partners may process technical identifiers (such as cookie IDs, device information, and approximate location derived from IP) to measure campaign performance, limit ad frequency, and deliver relevant ads on third-party sites. Legal basis: Article 6(1)(a) GDPR. You may withdraw consent at any time through Cookie-instellingen or by clearing site data in your browser.

We do not use sensational or misleading health claims in advertising. Landing pages clearly identify our business name, address, BTW number, contact details, and educational disclaimers.

7. Security Measures

We implement appropriate technical and organisational measures under Article 32 GDPR, including:

  • HTTPS/TLS encryption for data in transit;
  • access controls limiting who can view personal data;
  • regular review of data processing practices and third-party providers;
  • procedures to assess and respond to personal data breaches.

In the event of a personal data breach likely to pose a risk to your rights and freedoms, we will notify the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) within 72 hours where required, and inform affected individuals without undue delay where the breach is likely to result in a high risk.

No method of transmission over the internet is completely secure. You are responsible for keeping your own devices and credentials secure.

8. Your Rights Under the GDPR and UAVG

Under the GDPR and UAVG, you have the following rights in relation to your personal data:

  • Right of access (Article 15) — obtain confirmation of whether we process your data and receive a copy.
  • Right to rectification (Article 16) — request correction of inaccurate or incomplete data.
  • Right to erasure (Article 17) — request deletion where no compelling reason exists to continue processing.
  • Right to restriction (Article 18) — request limited processing in certain circumstances.
  • Right to data portability (Article 20) — receive data you provided in a structured, commonly used, machine-readable format, where processing is based on consent or contract and carried out by automated means.
  • Right to object (Article 21) — object to processing based on legitimate interests, including direct marketing.
  • Right to withdraw consent (Article 7(3)) — withdraw consent at any time for consent-based processing, without affecting the lawfulness of processing before withdrawal. You can withdraw cookie consent by clearing local storage or using our cookie banner settings.

9. Cookies and Similar Technologies

We use cookies, local storage, and similar technologies as described in our Cookie Policy. Non-essential cookies are placed only with your prior consent, in compliance with Article 11.7a of the Dutch Telecommunicatiewet and the GDPR. Google Consent Mode v2 is implemented to align analytics and advertising tags with your choices.

10. Third-Party Embedded Content

Our Contact page embeds Google Maps. When you load this content, Google may process technical data (such as IP address) under its own privacy policy. We recommend reviewing Google's Privacy Policy before interacting with the map.

11. Children

Our Website is not directed at children under 16 years of age (the minimum age for information society service consent in the Netherlands under Article 8 GDPR). We do not knowingly collect personal data from children. If you believe a child has provided data to us, please contact us and we will delete it promptly.
